  1. Use of Portal
    1. You must only use the Portal, or Our Material, for the limited purposes set out in paragraph 2(b). Subject to paragraph 2(b), you are prohibited from:
      1. reproducing Our Material;
      2. reselling or distributing Our Material;
  • re-transmitting the Our Material by any medium of communication;
  1. uploading and/or reposting Our Material to any other site on the Internet; and
  2. “framing” Our Material with other material on any other site on the Internet.
  1. You may access and download Our Material from the Portal solely for your own use provided that you must not:

  • you agree, to the extent reasonably practicable, to promptly update such Material to maintain their completeness and accuracy;
  1. Your Material is not defamatory or a malicious falsehood in relation to any product, service, person or corporation or set of facts or circumstances;
  2. Your Material is not the “passing off” of any product or service and does not constitute unfair competition or infringe the rights of any person or corporation;
  3. Your Material does not, and the Culture Quest Tours’s use of Your Material will not, infringe any IP Rights; and
  • Your Material does not infringe any laws.
  1. The Culture Quest Tours may reasonably request you to provide proof of your identity for verification purposes. By agreeing to these Terms you agree to promptly comply with any such request that is made.
  2. You agree to comply with rules, regulations and acceptable usage policies that may be in force for each system that you access via the Portal. If you do not, we may terminate or suspend your access to the Portal under paragraph 11.
  3. You will at all times indemnify and keep indemnified the Culture Quest Tours and our respective officers, employees and agents (Those Indemnified) from and against any loss (including legal costs and expenses on a full indemnity basis) or liability incurred by any of Those Indemnified arising from any claim, demand, suit, action or proceeding by any person against any of Those Indemnified where such loss or liability arose out of, in connection with or in respect of:
    1. any breach by you of the Terms;
    2. Your Material; or

By using the Portal you accept responsibility for:

  1. maintaining the confidentiality of any account information including user names, logins, passwords, and security questions and answers that you use to access any page or feature on this Portal;
  2. logging off from your account and any protected areas of the Portal;
  3. all activities occurring under your accounts, user names, logins, passwords, and security questions and answers including that which may result from your negligence, carelessness, misconduct, or failure to use or maintain appropriate security measures; and
  4. promptly reporting any suspicious or unauthorised conduct concerning your accounts, user names, logins, passwords, or security questions and answers to the Culture Quest Tours where you become aware of it.
  1. Licence to use Intellectual Property
    1. By uploading Your Material to the Portal, you agree to grant (or procure for) the Culture Quest Tours a perpetual, non-exclusive and payment-free licence throughout the world to:
      1. reproduce, use and exploit the IP Rights in Your Material to the full extent permitted by law in any jurisdiction in which the Portal is available to users for all purposes described in these Terms and any reasonably related secondary purposes; and
      2. allow the Culture Quest Tours to sub-license to others the same rights granted to the Culture Quest Tours in this paragraph 5.

  3. IP Rights

  • Online payments
    • . Online payments may be made through the Government EasyPay gateway operated by the Reserve Bank of Australia (Payment Gateway). The Payment Gateway charges a credit card surcharge including GST for successful Visa and MasterCard credit card payments and a Payment Gateway transaction fee. By making a credit card payment using the Payment Gateway, you agree to pay the credit card surcharge. The Culture Quest Tours will pay the Payment Gateway transaction fee.
  1. The Culture Quest Tours accepts no responsibility for the delivery of services by any independent third party service providers to the extent permitted by law and is not responsible for errors made by you when authorising any deduction against your credit or debit card.
  2. Subject to any responsibilities implied by law and which cannot be excluded, the Culture Quest Tours is not liable to you for any losses, damages, liabilities, claims and expenses (including legal costs and defence or settlement costs) whatsoever arising out of or referable to the Payment Gateway or to third party material, whether in contract, tort (including negligence), statute or otherwise.
  3. Any credit or debit card related data (including your credit or debit card details) will be stored and maintained in the Payment Gateway and not within this Portal.
  • Termination or suspension of access
    • . The Culture Quest Tours may terminate or suspend access to the Portal at any time without giving any explanation or justification for the termination or suspension. The Culture Quest Tours will have no liability for any costs, losses or damages of any kind arising as a consequence of terminating of suspending access to the Portal.
  1. If the Culture Quest Tours terminates your access to the Portal under clause 11(a), the Culture Quest Tours will provide you with a refund in respect of any payment made by you in advance for a service that is connected with this Portal, where that service has not been supplied to you. Where part of the service has been provided to you, you will be refunded for that portion of the service that has not been provided.
  2. If the Culture Quest Tours terminates your access to the Portal due to your breach of these Terms, you will not be entitled to a refund in respect of any payment made during your use of the Portal.
  • Alteration of Terms

The Culture Quest Tours may, at any time, and at the Culture Quest Tours’s absolute discretion, vary these Terms by making available a varied copy of these Terms on the Portal. If you continue to use the Portal following a change to the Terms you are deemed to have accepted the new Terms.

  • Removal of information

The Culture Quest Tours may remove any Materials included on the Portal, including links to other sites on the Internet, at any time without giving any explanation or justification for removing the Material.

  • General

  4. You agree to the non-exclusive jurisdiction of the courts of the Australian Capital Territory to determine any dispute arising out of these Terms.

Public submissions made on applications, permits or referrals may be published by us as part of the assessment process required under legislation.

We collect personal information about you so that we can perform our business activities and functions and to provide the best possible quality of customer service.

• administering services we are providing to you such as arranging your tour booking

When you provide your email address to Culture quest toursto make an online booking, your contact details may be retained even if the transaction is not completed. These details are captured using a secure service. This is so we can assist you in future with online bookings, and as a result of this you may receive a follow up enquiry email. This email will contain information on what action, if any, you
can choose that will direct us to cease any further contact with you or destroy the personal information we have collected about you.
We are only permitted to store your personal information for as long as necessary having regard to the purposes for which it was collected or a related or ancillary purpose. • In order for you to travel abroad, we may disclose your personal information where disclosure is required by government authorities at the point(s) of departure and/or destination to process your information for immigration, border control, security and anti-terrorism purposes.
• Where you provide us personal information for the purposes of booking travel related services on your behalf or on behalf of another person, we must provide such personal information to the travel providers you have selected for the purposes of completing the booking. We have no control over how travel providers use, disclose or store personal information. Please ensure you agree with the privacy practices of the travel providers you select prior to providing us your personal information for the purposes of booking travel related services with such travel providers. You acknowledge and agree that we provide your personal information to such travel providers solely as your agent and not as the principal holder and we will not be required to ensure their compliance with applicable privacy laws, this privacy policy or otherwise be liable or accountable for your personal information including without limitation their use and disclosure of your personal information.
Trans-Border Data Flows
When you provide, or otherwise allow us to collect, your personal information, you consent to your personal information being disclosed to third party overseas recipients, as set out below.
In providing our services to you, it may be necessary for us to disclose personal information to relevant overseas entities. For instance, we may need to disclose personal information to overseas recipients (third party overseas recipients), such as relevant overseas travel service providers for the purpose of arranging your booking with them.

Credit card security
• All online payments are transmitted over a secure socket layer (SSL) connection.
• Credit card information is transmitted immediately to a payment gateway solution via an encrypted port.
• Culture quest toursdoes not store your credit card number in any of our systems, it is used only within the context of the transaction then destroyed upon receipt from an acquiring bank.
